Terms of Service

Welcome to Brody. These Terms of Service ("Terms") are a binding agreement between you and Smarts Digital Products LLC ("Smarts Digital Products," "we," "us") governing your access to and use of the Brody product, including the website at askbrody.app, the web application, any mobile or desktop interfaces we offer, and any related services (collectively, the "Service").
By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Brody is an AI-assisted driving copilot. Our first feature predicts real-time parking availability in supported cities. Over time we plan to expand to fuel, hotels, reservations, and other driving-adjacent features. Some features are free; others require a paid subscription.
We pull data from public and commercial sources (including, in San Francisco, SFMTA and DataSF) and combine it with our own models. The Service is informational. It is not a guarantee that a specific parking spot will be available, that a price will remain unchanged, or that a rule will be in effect at a given time. You are responsible for verifying local signage and regulations before parking.
2. Eligibility & Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You sign in with an email-based magic link. You are responsible for maintaining the security of the email account used for sign-in. We are not liable for losses arising from unauthorized access if your email account is compromised. Notify us promptly at askbrody.app@gmail.com if you suspect unauthorized use of your Brody account.
3. Free and Paid Plans
The Service offers a Free tier and paid tiers (Pro, Business, and any future tiers we introduce). Paid tiers are billed through Stripe on a recurring basis at the interval you selected at checkout (typically monthly). By subscribing, you authorize us and Stripe to charge your payment method for the applicable fees plus any taxes.
Subscriptions auto-renew at the end of each billing period until you cancel. You can cancel at any time through the Stripe Customer Portal linked from the account page; cancellation takes effect at the end of the current billing period, and you retain access to paid features until then. Except where required by law, fees are non-refundable.
We may change prices or plan features with at least 30 days' prior notice by email or in-product. If you do not accept the change, you may cancel before it takes effect.
4. Acceptable Use
You agree not to: (a) access the Service by automated means other than through APIs we explicitly provide; (b) scrape, mirror, or resell Brody data; (c) reverse-engineer, decompile, or circumvent security controls; (d) interfere with or disrupt the Service or its supporting infrastructure; (e) use the Service to violate any applicable law, including traffic and parking regulations; or (f) submit false, misleading, or harassing content, including fake community reports.
We may suspend or terminate accounts that violate this section. For serious violations, suspension can be immediate and without advance notice.
5. User-Generated Content
If you submit reports, corrections, or other content through the Service (together, "User Content"), you retain ownership of that content. You grant us a worldwide, royalty-free, non-exclusive license to host, use, modify, and display User Content for the purpose of operating and improving the Service. You represent that you have the right to grant this license and that your User Content does not infringe any third-party right.
6. Third-Party Data and Services
The Service incorporates data from third parties (including SFMTA and DataSF in San Francisco) and relies on third-party services (including Supabase for data storage, Stripe for payments, Mapbox for maps, PostHog for product analytics, Sentry for error monitoring, and Resend for transactional email). We do not control these providers and do not warrant the accuracy, completeness, or availability of their data or services. Your use of features powered by these providers is also subject to their respective terms.
7. Driving Safety
Do not interact with Brody while operating a vehicle. Any hands-on use of the Service while driving is dangerous and may be illegal where you are. You are solely responsible for following the traffic, parking, and distracted-driving laws of your jurisdiction. Brody is a planning tool to be used before or after driving, or by a passenger.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT PARKING PREDICTIONS, PRICES, RULES, OR OTHER DATA WILL BE ACCURATE OR UP TO DATE. YOU USE THE SERVICE AT YOUR OWN RISK.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUES, LOST DATA, OR COST OF SUBSTITUTE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 100.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages; in those jurisdictions, our liability will be limited to the smallest amount permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Smarts Digital Products and its officers, employees, and affiliates from any claims, damages, or expenses arising out of your use of the Service in violation of these Terms or applicable law, or your infringement of any third-party right.
11. Termination
You may stop using the Service at any time. You can delete your account by contacting us at askbrody.app@gmail.com; we will delete personal data in accordance with our Privacy Policy and as required by law.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if continued provision is not commercially viable. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.
12. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will notify you by email or in-product and update the "Last updated" date above. If you continue to use the Service after the change takes effect, you accept the updated Terms. If you disagree, stop using the Service and, if you have an active paid subscription, cancel it.
13. Governing Law and Venue
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.
